Helmco Manufacturing, Inc.,
hereinafter referred to as HMI or Helmco, warrants
all its products to be free from defect and to be in
compliance with HMI specifications in effect at time
of manufacture. HMI will replace or, at its option,
refund the purchase price, of any HMI product that
fails to meet the above specification and of which
HMI is informed of in a reasonable amount of time
from date of manufacture.
*Except as expressly
warranted otherwise. Helmco makes no other warranty
of any kind whatsoever, express or implied, and all
implied warranties of merchantability and fitness for
a particular purpose are hereby disclaimed and
expressly excluded.
Any liability, including any
implied warranties, if any, between parties is
limited to the terms herein. Under no circumstances
will Helmco Manufacturing, Inc. be liable for any
special, incidental, or consequential damages
whatsoever. Such damages include, but are not limited
to, loss of profits, loss of revenue, loss of any
associated equipment, cost of capital, cost of
replacement equipment, facilities, or the claims of
third parties, including customers of customer.
